Employment Law: Partner Ron Van Wert argues before the WA Supreme Court

On June 9, 2015, EMLVO Partner Ron Van Wert argued before the Washington State Supreme Court in a case that, with 2 other companion cases, might determine the fate of the state cause of action known as wrongful discharge in violation of public policy.  In the trial court, Ron succeeded in getting the case dismissed on summary judgment.  Division III of the Washington State Court of Appeals, in two published decisions, upheld the trial court’s decision in favor of Ron’s client.  Ron’s argument on behalf of his client is supported by almost 20 years of precedent.   However, the questions posed by various Justices during Ron’s argument, and during the arguments in the companion cases, evidence the Court’s intent to analyze whether the test used over the last 20 years is justified.  Consequently, the cause of action of wrongful discharge in violation of public policy remains in limbo while the Court decides the three cases.  The Court’s decision is not expected until spring 2016.
