Municipal Law: Mike Connelly and Megan Clark Argue Before WA Supreme Court

On May 18, 2017, EMLVO Partner Michael F. Connelly and Associate Megan Clark argued before the Washington State Supreme Court in a case of first impression which may determine whether a city is entitled to enact its own local property tax exemptions.  Mike and Megan represented the Spokane County Treasurer and Assessor.  While the trial court sided with the City of Spokane, EMLVO and the Department of Revenue successfully appealed and the Court of Appeals reversed the decision of the trial court, holding the Ordinance was unconstitutional, violating the Constitution’s tax uniformity requirements.  The City of Spokane sought review by the Supreme Court.  A decision is expected this winter.
